Loni Love On Conversation With Jussie Smollett: He's "Going Through It"

The Cook County State's Attorney whose office was tasked with handling the prosecution of "Empire" actor Jussie Smollett at one point referred to him as a "washed up celeb who lied to cops" yet argued that he was being charged with an excessive amount of felonies.

"(A pedophile) with 4 victims 10 counts.

Foxx texted back and apparently compared the Smollett case to the sex abuse charges against singer R. Kelly.

Smollett reportedly participated in a reading for the part just 12 hours before he claimed he was attacked on the streets of his home in Chicago by two men who he said threw a rope around his neck and poured a bleach-like substance on him.

"Sooo.... I'm recused, but when people accuse us of overcharging cases.16 counts on a class 4 (felony) becomes exhibit A", Foxx wrote to Magats.

"After reviewing all of the facts and circumstances of the case, including Mr. Smollett's volunteer service in the community and agreement to forfeit his bond to the City of Chicago, we believe this outcome is a just disposition and appropriate resolution to this case", the Cook County State's Attorney's office stated in an email at the time. The Chicago Police Department has also denied public-records requests for its internal documents on the same grounds.

Smollett, who is black and openly gay, told police he was attacked as he was walking home around 2 a.m. on January 29.

Joseph Magats, the First Assistant in the State's Attorney's office, ultimately made the decision not to prosecute the case.

The texts are among dozens sent between Foxx and Magats after Foxx claimed she stepped away from the case.

But three days later, in a text stream with top state's attorney staffers titled "Foxxhole", Foxx commented on a news article writing, "Funny the theory that everyone is related to this guy is pervasive". But Foxx's office has since said she removed herself from the case only informally, since an actual recusal would have required her entire office to step aside and request the appointment of a special prosecutor.

Jussie Smollett has confided in a select few of his celebrity peers since his alleged hate crime scandal, and the latest public figure to open up about her conversation with the embattled actor is comedian Loni Love.

Nonetheless, charges against Smollett were announced the next day, and a grand jury indictment was handed up two weeks later.

John and Mayor Rahm Emanuel held a news conference that morning blasting the prosecutor's decision, calling it a "whitewash of justice".

After the charges were dropped, Foxx went on the offensive. In an op-ed in the Tribune, she backed off her office's initial stance that the case was strong, writing that they were uncertain of a conviction, but she offered no specifics. She called on the Cook County Inspector General to take a look.
