Cuba Gooding Jr.’s attorney says groping accuser was ‘stalking’ the actor

Hollywood star Cuba Gooding Jr. has been arrested and charged with a misdemeanour after a 29-year old woman filed a police report claiming the Oscar victor grabbed her breast at Magic Hour Rooftop Bar & Lounge in Manhattan on Sunday.

A 29-year-old woman claimed he grabbed her breasts in the Magic Hour Rooftop Bar and Lounge in NY. According to reports, the woman said Gooding was "highly intoxicated" at the time.

Security footage from the Magic Hour Rooftop Lounge, obtained and posted online by TMZ, shows Gooding and his girlfriend sitting on a couch when the accuser sits down next to them. "I frankly am anxious and terrified that this case is being prosecuted".

Heller said Gooding had "no knowledge" of the alleged 2008 incident, which falls outside the statute of limitations for any potential charges.

Gooding, 51, was charged after turning himself in to investigators in the New York Police Department's special victims division.

"There is no pattern of conduct", Heller said. In that case, a bartender said the actor was agitated with patrons who wanted photos with him and that he pushed her when she asked him to leave.

However, hours later, TMZ published the surveillance video said to be shot inside the Manhattan nightclub on Sunday.

If convicted of the charges, he faces up to a year behind bars, in addition to three years of probation and a $1,000 fine. He is due back in court June 26.

The actor exploded onto the scene in 1991 after appearing in Boyz n the Hood.

More recently, he played OJ Simpson in "The People vs OJ Simpson: American Crime Story".
