Instead of checking on Epstein regularly, according to the indictment unsealed Tuesday, Noel and Thomas "sat at their desk, browsed the internet, and moved around the common area of the SHU (Special Housing Unit)".

Epstein had pleaded not guilty to child sex charges, including the alleged abuse of girls as young as 14, in NY and Florida in the early 2000s.

The arrests and subsequent charges will be the first to stem from a criminal inquiry into Epstein's death.

Epstein's suicide, at age 66, came a little over a month after the well-connected money manager was arrested and charged with trafficking dozens of underage girls as young as 14 from at least 2002 to 2005.

Noel and Thomas are expected to be arraigned later Tuesday.

According to the Federal Bureau of Prisons, which runs the MCC, the last inmate suicide at the facility was in 2006. The financier was taken off suicide watch shortly before he died, despite having already been found unresponsive on the floor of his cell once - also by Thomas - and had his cellmate transferred just hours before he was found dead.

Yankees-Red Sox Series Heats up AL East Race
The New York Yankees won the series, winning 8-1, losing 11-0, and winning 11-1 to make up some ground on their rivals. Despite sitting on top for much of the season, the Boston Red Sox are expected to lose steam as the season progresses.

"The FBI is involved and they are looking at criminal enterprise, yes", Sawyer replied. "I am committed to this agency and am confident we will restore the public's trust in us".

The falsification of records has been a problem throughout the federal prison system, which has been plagued for years by systematic failures, from massive staffing shortages to chronic violence.

The two Federal Bureau of Prisons employees appeared in the federal court in Manhattan.

"As alleged, the defendants had a duty to ensure the safety and security of federal inmates in their care at the Metropolitan Correctional Centre", said USA attorney Geoffrey Berman. To hide their failure to perform their duties, NOEL and THOMAS repeatedly signed false certifications attesting to having conducted multiple counts of inmates when, in truth and in fact, they never conducted such counts. Prior to the criminal cases against him, he was best known for his wealth and high-profile connections.

The nation's top prison administrator, Kathleen Hawk Sawyer, told the committee that FBI agents investigating Jeffrey Epstein's death are looking at the possibility that a "criminal enterprise" played a role in his suicide. A forensic pathologist hired by Epstein's family to observe the autopsy has said authorities could help clear things up by being more transparent.

During the Newsnight interview, Andrew, questioned by presenter Emily Maitlis, twice stated his relationship with Epstein, who died in jail while facing sex trafficking charges, gave him the opportunity to meet people and prepare for a future role as a trade envoy. The prince has denied the claim.
