Khalil Ferebee, Brown's son, said his father was trying to "get away" when the officers shot him. He backed out of the driveway, maneuvering around the sheriff's truck and away from the deputies. "It was 20 seconds and we lost count of how many shots". "He was trying to evade being shot".

"They're shooting and saying "Let me see your hands" at the same time", she said.

Wooten's office said on Friday that seven sheriff's deputies were placed on administrative leave after the shooting and that three additional deputies had resigned, although the resignations were not related to the shooting. The names of the deputies have not been released.

There has been rumors circulating that the National Guard is in Elizabeth City for this event. The emergency declaration went into effect at 8 a.m. and Parker said it will last "until deemed no longer necessary".

Also Monday, Elizabeth City officials declared a state of emergency amid concerns about how demonstrators would react to a possible video release.

A planned protest began at 7 the Pasquotank County Public Safety Building on Monday.

The day after the incident, Wooten justified withholding the footage by responding that only a judge could authorize its release, and he had asked the North Carolina State Bureau of Investigation to confirm that doing so would not undermine their work.

Brown was shot and killed last Wednesday as Pasquotank County Sheriff's deputies were serving a warrant on felony drug charges.

Harry Daniels, another attorney for the family, said he has been told by authorities that three deputies opened fire on Brown's vehicle, including one who reloaded.

"Mr. Brown was a convicted felon with a history of resisting arrest", Fogg said in the video posted late on Thursday.
